1. Is there a limit to the number of times I can use
the forms?
No. When you purchase the Royalty Owner Forms Program, the License
Agreement allows you to use the forms in the Program as many times as
you wish.
2.
What happened to "Know All Men by These Presents" in the
forms?
We've never been able to find anyone to explain the significance this
phrase has in today's documents, and have never included the
phrase in any forms. In addition to eliminating this phrase, the
forms in the Royalty Owner Forms Program have been written in plain
English, with as much legalese eliminated as possible. This makes the
forms easier to read and work with.
3. Who prepared the forms in the Royalty Owner Forms Programs?
The forms in the Royalty Owner Forms
Program were written and compiled by the partners of Kanes
FormsTM
; Mike Atnipp and Doug Atnipp. For
information about them and their qualifications, on the Menu Bar at the
top of the page, click on "About/Contact Us." On the pull down menu,
click on Mike Atnipp or Doug Atnipp for more information about each of
them.
4. Is the
Royalty Owner Forms Program available in a network version?
No.

What methods of payment are accepted to purchase the Kanes Forms
Programs?
You may pay for the Program by check, money order,
or credit card. MasterCard, Visa, Discover, and American Express are
accepted.
6. How do I order the Royalty Owner Forms Program?
On the Menu Bar at the top of the page, click
on "Price/Order". You may then click on the method you wish to use to order the Royalty
Owners Forms Programs; mail, phone, fax, or online.
7. Can I revise the forms to meet my particular
needs?
Absolutely. All the
forms are in text form, that can be edited, revised, added to, and amended any
way you wish, so that the document you prepare will meet your specific
transaction needs.

Can the forms be used in all states?
Yes. All forms can be adapted for use in any state.
9.
How soon after I place my order will I receive my Program?
Your order will be shipped within 2-3 business
days after your order is received. Most orders received by 3:00 P.M.,
Central Time, with payment, are shipped the day they are received. All
orders received by Kanes FormsTM
in Midland, Texas, are shipped directly from
that office. The regular method of shipment is by United States Postal
Service Priority Mail, providing for 2-3 day delivery in the continental
United States. If overnight delivery is requested, it is available by
UPS Next Day Air, with the cost of this special delivery being paid by
the customer.
10. What word processing program
is needed to use the forms on my computer?
The Royalty Owner Forms Program
works with any version of any word processing program. You must have a
word processing program on your computer to make full use of the forms.
When you save a form, you have the option of doing so in Microsoft Word,
or if you use another word processing program (such as WordPerfect), you
may save forms in RTF (Rich Text Format).
11. How long
does it take to learn to use the Royalty Owner Forms
Program?
Maybe up to 5 minutes! There is
no new program to learn to make full use of the Royalty Owner Forms
Programs. You must be able to use the word processing program on your
computer to make full use of the forms in the Program.
12. Can I
purchase a single form?
At this
time, Kanes FormsTM does
not sell individual forms.
13. Is the
Royalty Owner Forms Program Guaranteed?
Yes. If
for any reason, during the first six (6) months after you purchase
the Program, you are not satisfied with your purchase, return it to
Kanes FormsTM and the price you paid for the Program will be
refunded in full (less shipping and handling). No questions asked. In
addition to this money back guarantee, if the Program CD is found to be
defective (doesn't work for any reason), return it to Kanes
FormsTM
. We will replace the Program you
purchased, at no charge.
14. Who has
purchased the Royalty Owner Forms Program?
Royalty and Mineral owners across
the country have purchased the Royalty Owner Forms Program.
Attendees at the 2002 and 2003 Texas and National Association of Royalty
Owners have purchased the Program. The response from these
customers has been excellent.
15. Why don't
the forms have the "legalese" I'm accustom to seeing in
documents?
In preparing the forms in the
Royalty Owner Forms Program, a diligent effort was made to
eliminate much of the "legalese" from the documents, and write them in
plain English. Eliminating "whereas," "heretofore," "witnesseth," etc.,
does not change the legal significance or meaning of the text of the
forms. It does make them easier to read and more concise.
16. Can I
duplicate the Royalty Owner Forms Program CD?
The Kanes
FormsTM License Agreement
does not permit you to duplicate or "burn" the Program CD to create
an additional copy. We have made significant efforts to provide our
customers many useful forms, at a very reasonable price. To do so we
have minimized the security systems in the Program, to allow you to run
the Program on several computers, as long as you have the Program CD
available. We recognize the occurrence of software piracy, in general,
is very prevalent, and by limiting the security systems in
the Program, we open ourselves up to that risk. However, to
accommodate the majority of our customers, we've kept the Program
simple, trusting them not to duplicate the disk for the benefit of
unlicensed users.
17. Will the
Royalty Owner Forms Program be updated?
Not
anytime soon. The forms in the Royalty Owner Forms Program are
based on forms of documents that have been used for over 50 years in oil
and gas and mineral and royalty transactions. In the 15 years
Kanes FormsTM
has been providing forms
for use in oil and gas transactions, only style changes have been made,
the substance of the forms has not changed.
18.
What if I can't use a word processing program?
To make full use of the
Royalty Owner Forms Program, you really need to be able to use a
word processing program.
19. What if I don't like the way the forms
are formatted?
You can change the format of any of the forms to
meet your particular preference. While the format of many of the forms,
in setting out the name of the Grantor, Grantee, Effective Date, etc.,
in subheadings, was new for some in 1989, it has been well received and
is used by many Kanes FormsTM
customers.
There are some who prefer a more traditional format that sets out this
information in narrative form. That is easily accomplished by modifying
any of the forms to adapt them to the style you prefer, by including the
information in the first paragraph of your document.
20. How does the License Agreement for the Royalty
Owner Forms Program allow me to use the
forms?
The Kanes FormsTM
License Agreement allows you to use all the forms as many times as you
want to, and install the program on any computer. The License
Agreement does not allow you to duplicate, "burn," or copy the Program
CD or to sell the forms as your own. To see the complete License
Agreement, on the Menu Bar at the top of the page, click on "Tech and
Legal Stuff." On the pull down menu, click on "License
Agreement."
21. Are the forms available in a book or print form?
No. Kanes FormsTM
no longer publishes the forms in a print version.
22. How does the Royalty Owner Forms Program work?
For a complete
description of how the Royalty Owner Forms Program works, on the
Menu Bar at the top of the page, click on "Tech and Legal Stuff." On the
pull down menu, click on "How the Program Works."
23. Does the Program have an instruction manual that
will show me how to use it?
The Program CD is accompanied by instructions
on how to install the Program on your computer. Because there is no new
program to learn, there is no "instruction manual." When you open the
Program, you will find information on how to use the Program, called
"Tips." This page describes the simple functions of the Program on how
to locate, view, save, or copy a form. If you need more information or
assistance, you can always call Kanes FormsTM
toll free, at 1-800-526-3790.
24. What do the forms look like?
Click on
"Available/Sample Forms" on the Menu Bar at the top of the page, you
will be taken to a page that provides a view of each form in all the
Royalty Owner Forms Program.
25. Is it difficult or time consuming to install the
Royalty Owner Forms Program on my computer?
No. Once you insert
the Royalty Owner Forms Program disk in the CD drive of your
computer, the installation process should begin. To complete the
installation process, follow the directions on the screen. If the
Program does not install automatically, the Program is delivered with
simple installation instructions.
26. Can I install the Royalty Owner Forms
Program on more than one computer?
Yes. The Kanes FormsTM
License Agreement allows you to install the Program you purchase on any
computer, and any number of computers.
27. Does the Kanes
FormsTM License Agreement allow more
than one person to use the Program?
Yes. One of the
better ways we've found to describe how a Program can be used, is to
compare it to a library book. The operating functions of any of the
Royalty Owner Forms Programs can be loaded on any computer. The Program
CD must be installed in that computer's CD drive to access the forms on
the Program. This enables multiple parties to use the Program, but only
one at a time.
28. What does the Royalty Owner Forms Program
cost?
On the Menu Bar at
the top of the page, click on "Price/Order." The price
of the Program is available on that page, as well as how you
may order the Program by phone, fax, mail, or online.
29. Does Kanes
FormsTM provide 24/7 live technical
service and support?
No. "Live" technical
support is available Monday through Friday during normal business hours
(Central Time). If you call after those times, leave us a message and we
will return your call the next business day. The Royalty Owner Forms
Program is so simple to install and use, there is very little need for
technical assistance.
30. Can I place an order after regular business
hours?
Yes. Fax and online
orders are received 24/7. If you wish to order by phone, the toll free
800 number for Kanes is answered Monday through Friday, during normal
business hours (Central Time). At all other times, you may leave a
message and your call will be returned the next business day, to take
your order.
31. Where is Kanes
FormsTM located?
Kanes FormsTM is
located in Midland, Texas.
32. I haven't heard of Kanes FormsTM
. Why?
Kanes FormsTM
have been providing forms for use in oil and gas transactions since
1989, but has not engaged in a great deal of commercial advertising,
primarily to hold down costs and pass the savings on to our
customers.
33. Are the forms in the Royalty Owner Forms
Program intended to provide legal advice?
No. While the
forms are written and edited by attorneys, they are not intended to
provide or be a substitute for legal advice. As specified in the License
Agreement, they are intended to be used by those with experience in
drafting oil/gas/energy transaction documents, with, or in conjunction
with advice from experienced practitioners.
